Terms of Service

The deal, in plain words: you get a tool that sends email from your own mailbox, and you take responsibility for what you send with it.
1. Who this agreement is with
Mailmize, operated by Sawyer Higgins, a sole proprietorship at 133 Indian Lake Blvd, Hendersonville, TN 37075 (“we”, “us”). By creating an account you agree to these terms. If you do not, do not create one.
2. What the service does
It connects to a mailbox you already control and sends messages you have written, on a schedule you have set, to a list you have supplied. Mail is sent through your own provider, from your own address. We are not an email service provider and do not relay your mail through our own infrastructure.
3. Your account
- You must be at least 18 and able to enter a contract.
- You are responsible for keeping your password to yourself, and for everything done through your account.
- One person or business per account. Do not share a login to get round plan limits.
- Tell us promptly if you think someone else has got into your account.
4. What you may not do with it
This is the part that matters, and it is not negotiable. You may not use this service to:
- send email that breaks the CAN-SPAM Act or any equivalent law where you or your recipients are — including sending without a valid physical address, with a misleading subject line or header, or without a working way to opt out;
- continue emailing anyone who has asked you to stop;
- send to a list you have no lawful basis to email, including scraped or purchased lists where consent is required;
- send anything unlawful, fraudulent, harassing, or designed to deceive the recipient about who it is from;
- impersonate anyone, or use a From address you do not control;
- send bulk mail from a mailbox belonging to an employer who has not permitted it;
- resell or white-label the service without written permission;
- attack, overload, reverse-engineer or attempt to break into the service.
Accounts doing any of the above are suspended, usually without warning. The reason is not squeamishness: mail sent through this service carries your provider's reputation and ours, and one account sending to a bought list can get an entire sending platform blocklisted.
5. The email you send is yours
You are the sender. Every message goes out under your name, from your address, through your mailbox. That means the legal responsibility for its content, for your list, and for compliance with CAN-SPAM and any other applicable law is yours. This service gives you the tools to comply — a required physical address in every footer, a permanent opt-out list, an unsubscribe link — but it cannot and does not check what you send or who you send it to.
You agree to indemnify us against claims arising from what you send, or from the list you sent it to.
6. Plans, billing and cancellation
- A free plan and a paid plan are offered. What each one includes is shown on the Upgrade page inside the app, and applies from the moment you subscribe.
- Paid plans are billed monthly in advance and renew automatically until you cancel. The price and the billing period are shown before you enter any payment details.
- Payment is taken by Stripe. We never see or store your card number.
- You can cancel at any time, from the billing link inside the app or by asking through the Support tab inside your account. Cancelling stops the next charge; access continues to the end of the period you have already paid for.
- Prices can change. Existing subscribers are emailed before a change takes effect and can cancel first.
- Refunds are covered by the Refund Policy.
7. Sending limits
Daily limits per mailbox exist to protect your own mailbox from being restricted by your provider, and they are enforced. Your provider's own limits apply on top of ours and are outside our control.
8. Availability
This runs on ordinary commercial hosting and no uptime guarantee is offered. The service may be unavailable for maintenance, and features may change. Anything that would lose your data gets notice first.
9. Your data
Your contacts and campaigns remain yours. We claim no ownership of them and do not use them for our own purposes. See the Privacy Policy. You can export your send history at any time, and ask for your account to be deleted.
10. Ending it
You can close your account whenever you like. We may suspend or close an account that breaches section 4, that is used for something unlawful, or where payment has failed and gone unresolved. Where the reason allows it, you will be told what the problem is and given a chance to fix it.
11. Warranties and liability
The service is provided “as is”, without warranties of any kind to the extent the law allows. It is not warranted that your email will be delivered, will reach an inbox rather than a spam folder, or will produce any particular result — deliverability depends on your domain, your list and your provider, none of which are ours.
To the extent the law allows, our total liability for any claim relating to the service is limited to the amount you paid in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited.
12. Governing law
These terms are governed by the laws of the State of Tennessee, and any dispute goes to the courts there.
13. Changes to these terms
If these terms change materially, account holders are emailed before the change takes effect. Continuing to use the service after that means accepting the new version.
